Balk called..Batter steps out

Situation was runners on first and third.
Balk called..Batter steps out with one foot and raises his hand, umpire does not grant time, pitcher stops in mid-motion and the umpire calls BALK.
My thought is that the batter cannot commit an act to cause a balk, Rule3-3-1 o; my question is two fold am I correct and is there a case book scenario?
