He could have made the throw on this play because the ball was not dead. Go to the ump forum and ask this question or do the search function on foul tips or something like that.
There is a LOT to this rule that the vast majority of people don't know. I asked a similar question a little while ago but there is a ton to this rule.
But to answer your question yes the ball was live and he could have thrown it.
