A batter-runner beats out an infield single on a close play and makes a big loop to his right into foul territory. Noticing that the ball got away he takes 3 steps towards second base but stops before crossing into fair territory. The fielder then tags the runner before he goes back to 1st base. Is he out?

Probably. As I see the action you described, I'd bang him out. Being in foul territory has nothing to do with it. The only question is "did those three steps appear to be an attempt".

Stopping the attempt also has nothing to do with it.
