With a runner on first only the pitcher comes to the set position then steps toward third with his pivot then turns to first. Is this a balk?

If he comes set, he has to disengage the rubber by stepping backwards off the rubber with his pivot foot (OBR 8.01b, don't know whether it's different for FED/NCAA).
The way you describe it yes, it's a balk.

If that's all he does then its a balk. If he continues by stepping to first with the nonpivot foot and throwing to first (all in one continuous motion of course) then its a legal move. this "jab step" is considered a move from the rubber. Its probably the most common way a RH pitcher throws to first.
