balk question

I believe this is a balk but I know someone who swears its not and he said he has asked some umpires-here's the q: a pitcher with his foot on the rubber, but not in the set position, and the ball not in his glove, arms apart,(right hander) attempting to pick 3rd, makes no feet movement but flips the ball to third. Is or is this not a balk?

That would be balk. F1 has to make a step to the base he is going too. This is the "ole snap throw"
it can only be accomplished if the pivot foot steps back, first.

The problem lies in the belief some umpires have that all pitching regulations in OBR begin when F1 comes set, as opposed to touching the rubber as in FED.

There are exceptions.
