a called third strike that is not caught or a swinging third strike that is not caught is the same thing......if first is not occupied or if there are 2 outs, he is free to attempt to advance to first.....

Either way its a play on......
So why is he out for interference? He swung at a ball and just swung late. If he doesn't hit the ball, it is a great swing but if he hits the ball it is interference. I have a problem with this. I understand if you felt he intentionally swung late to hit the ball or catcher but that is not what was said. He swung late and the catcher did not catch the ball and he happened to hit it.
In the OP, if the batter hit the ball on the follow through under FED rules he would be out for interfering with the catchers opportunity to field the ball.

NFHS Rule 7.3.5f

if a batters follow through hinders the catcher attempting to field a ball or make a throw, the batter is guilty of interference.

Penalty- the ball is dead, batter is out, runners remain at time of interference base.[
