This is a video of a batter getting hit. From what I see, he actually lifts his arm a bit in addition to not getting out of the way. Remember, watching a video ... expecting the outcome ... is a whole lot different than not being alert at all times and incorrectly making a call. Not looking so much for judgement; rather, philosophies on how to look at a situation such as this. ie:, was pitcher throwing a (lefty) curve, knuckleball? Any "agendas" before game started? Is it 23 -0 in the 2nd? Does the game situations change your decision? Should they?

Looks like he didn't make an attempt to get out of the way to me either. If he would have even turned his shoulders a little, HBP. As it looks to me, he didn't make an attempt, no HBP. Game situation should not matter. The situation in a game should never dictate how you apply the rules. I'm not an ump, but that's what I think.

Just one umpire's opinion.
The batter in the video didn't make any reasonable effort to avoid being hit by the pitch nor did he appear to be "frozen" by the pitch. His knees didn't buckle; heck he didn't even take a stride of any kind. He simply stood stock still and let the ball hit him. He stays in the box.

As far as the other questions go, I don't consider agendas, score or game situations when determining whether a batter goes to first or stays at the plate. Each occurrence stands on its own merit.
