Yes, it most certainly does.....with 2 outs if the ball is not legally caught "in flight", the the D3K or more properly the "3rd strike not caught" applies

Rule 6.09 B in OBR and I think 2.20.2 in FED.

Rule 6.05B gives you the definition of legally caught...

6.05 (b) A third strike is legally caught by the catcher;

Rule 6.05(b) Comment: "Legally caught" means in the catcher's glove before the ball touches the ground.
