We went through this last summer. Yes. You can transfer from D3 to D1 with a release from your current program. Found out a DI cannot give you athletic aide for the first year but you can play immediately per NCAA guidelines. Wonder if the limitation on athletic scholarship is legal? Did not have to deal with Clearinghouse issue so did not research how if at all that might make a difference.
A D-III player can transfer to a D-I school, but, if I'm not mistaken, cannot play until the player's high school record goes through the Clearinghouse. Otherwise, the player is a non-qualifier and is subject to the rules surrounding a non-qualifier.
I would think, though, cases like this are very rare indeed.
