Is this not a balk/illegal pitch?

Only if the engagement was intentional.

It was since he would immediately go into getting the signs for the next pitch and it happened 5 times in the game with no call on any of them and a disengagement of the plate with the non pivot foot from the wind as well.

By an overly-strict, literal reading of the rule, it's illegal (or you can make that case).

But what the rule really means is that "the pitching restrictions begin once the pitcher completes the process of taking the rubber."
