Okay, man on first, pitcher has the ball and is standing on the back of the mound (near the grass line). Without stepping on the rubber, pitcher throws to first, and gets the runner, who was already leading, out. Ump rules it a balk. Now, my question is, wouldn't it be a dead ball since he never stepped on the rubber?

Did the ump give any indication as to why he called a balk? There is nothing illegal about the pitcher standing on the back of the mound with the ball.

If the ball was live you have an out. If the ball was dead then you have nothing.

Unless there is more info than you provided I don't see a balk in your situation.
