base on balls...and the ball gets away from the catcher

The pitcher throws ball four and the ball skips past the catcher and goes to the backstop. The baserunner takes off for first and runs through the bag but does not make any move to go for 2nd. He stops running and turns to go back to first. Question: after the baserunner touches first and then runs past it, can he be tagged out?

If there was no attempt to go toward second (he went straight through the bag), he cannot be tagged out. However, if he did take a turn around first base (towards second) he could be tagged out.

Depends on code. In OBR states as long as he immediately returns to first...no problem. (Immediately returning to first has been interpreted as no attempt or feint towards towards second)

In FED he is awarded safe passage to the bag only.
