It is also a balk if a runner or runners are on base and the pitcher, while he is not touching the pitcher's plate, makes any movement naturally associated with his pitch, or he places his feet on or astride the pitcher's plate, or positions himself within approximately five feet of the pitcher's plate without having the ball"

A. The ball must be live. If a player calls time, see 2. above. No one can be out now.

B.The pitcher cannot step on or straddle the pitcher's plate without the ball (MLB 8.05)

C. Cannot simulate a pitch. Cannot look like a pitcher. (MLB 8.05)

If none of the above 3 items are violated, you have an out...if the runner is off the base. If all items are not correct, you have a balk or nothing.
in a seventh grade game one of the teams tried it, but they called time first. the first baseman runs over and before anyone says play ball or indicates to play, he tries to tag the runner. i called him safe because it was still a dead ball. but then the ump behind the plate and i noticed then that the pitcher had toed the rubber w/out the ball. we decided to just leave it as it was and not call balk because it was a dead ball. could we have called the balk?
