What is the rule on transferring from a dII school to a dI? do you sit out a year or what?

It's been linked somewhere else, but I'd suggest looking up the Transfer Handbook at the NCAA.org site.
Generally you can avoid sitting out a year if this is the first time you've transferred and you get a release from your old school. If you're going to D1 you have to abide by their rules.
