Batter digging around in the box, PU gives the 'DO NOT PITCH' signal (Fed, pp72,"A").
All of the sudden, F1, throws to F3 and picks of R1.
Question: Is R1 out or was time out?

Time is out, put R1 back.
This is exactly why it is a bad idea to use that signal. The only time I use it is when the ball is already dead, and I'm holding up the pitcher while the batter gets set (to be followed by pointing at the pitcher and calling "play").
