We had a friendly disagreement at a recent game on how to score a particular play. The crux of the matter is this...can you assume a double play, and thus give an error if the second out is not executed correctly?

Here's what happened. R1 and no outs. Hard grounder to short, he flips to 2B who turns and makes a low throw which is not caught by 1B. 2B had a clear throw as R1 was nowhere near him. The batter/runner was quite slow and would have easily been out had the throw/catch been executed correctly.

Do you give an E4 on this or is it simply a FC?

No error in the situation you've described.

OBR 10.14(c) "(c) No error shall be charged against any fielder when he makes a wild throw in attempting to complete a double play or triple play, unless such wild throw enables any runner to advance beyond the base he would have reached had the throw not been wild.

NOTE: When a fielder muffs a thrown ball which, if held, would have completed a double play or triple play, charge an error to the fielder who drops the ball and credit an assist to the fielder who made the throw."
