First and third balk

Runners on 1st and 3rd. Pitcher comes to the set position, runner on 1st starts toward 2nd slowly in an attempt to get in a rundown. Pitcher still in set position with foot contacting the pitching rubber spins toward 2nd while never losing contact with the pitching rubber and makes the throw. Since he did not disengage the pitching rubber and threw toward 2nd is this a balk.

No balk. He is allowed to throw to an unoccupied base to make a play. Turning to 2nd with foot on the rubber is also OK.

As already answer it would be no balk. It still wouldn't be if he didn't throw.
