Agree that the place for this thread is in "Ask the Ump", in fact there was one of these discussions there not too long ago. Short answer was that in MLB and HS rules the batter must, IN THE UMPIRES JUDGEMENT, make an attempt at avoiding the pitch. In college the batter doesn't need to make that attempt IF the pitch hits him within the vertical confines of the batter's box.

Also, a batter can't be called out for not avoiding a pitch. Proper call would be either 'ball' or 'strike' depending on the pitch, and dead ball. (Of course if it were a called strike-3 the batter would be out.)
