If the umpire never put the ball back in play, he can't pick him off anyway.

Besides the point, in OBR, there is no penalty for not retouching, it is just the umpire's job to make sure the runners retouch before the ball is put back in play. There is nothing like "he has not occupied the base again" or anything like that. Bottom, line, no penalty, this is just part of proper game management for the umpire.
