Assault can be verbal if the person feels threatened. Or lies and claims they were threatened. Battery is physical. Are you going to assume someone who is yelling at a kid at a sporting event is a mature adult?

Obviously, innocent people are arrested and convicted every day. You can get arrested anytime for anything, innocent or not.
