We are hearing about classmates who plan to transfer from public to private schools in our area next school year. We are told that they will be eligible to play immediately because none of the public schools in our district are meeting Adequate Yearly Progress, and technically, they are transferring for academic reasons. In most cases, they really are - these are not necessarily studs who are moving for stronger athletic programs. Their families want a better education for them, but they'd also like to continue playing their sport(s).

Does anyone know if this is the case? I couldn't find anything on the IHSA website that speaks to this situation.

We actually moved while kids were in high school. The IHSA sections referenced were the guides. As a matter of fact, daughter was declared ineligible at new school for scholar bowl because she had participated at the old school prior to transfer. I am unaware of any modification to these guidelines because of failure to meet AYP. I know that if you fail to meet for an extended period, kids may transfer to another school, if that school will accept them, but that is public to public. I am unaware of any provision that would allow this unless it is in conjunction with physical move and/or guardianship changes.

I didn't find anything else addressing this on IHSA. However, on the Illinois State Board of Education site, isbe.net, there was an overview of choice due to non ayp performing schools. Choice, transfering from a non ayp school, was only available to another public school. Therefore, my initial conclusion is that public to private transfer would have to sit out a year. If it were my children, I would want an interpretation from IHSA before I transferred them, IF IHSA eligibility is a factor in the move.
