38 would be the roster for the championship season. No cuts. Has to be voted on.

38 for the Championship season seems like it could be a huge blunder (at least to me and my understanding of what the NCAA has filed with the Court in the House settlement.) My understanding is the NCAA committed to 34 roster spots in baseball? That commitment is filed with the Court.

I’m not familiar with the specifics of court filings but I think a practical solution would be to allow a small (4 man) practice/development squad on top of the 34 roster spots. In the event of injury to a rostered player a player could be elevated from the practice squad if desired. This would allow some cushion in the fall and would not require players to transfer at semester if they didn’t make the 34 man roster. It would also allow a few players the chance to develop their game and work towards making the 34 man roster the next year - so maybe it would reduce the number of kids running to the transfer portal.
The important part of the House settlement in this regard is eliminating scholarship limits. I don’t think the judge would care one way or another between 34 or 38 for a roster limit. The key is that there can’t be a scholarship limit that is less than the roster limit.

The danger in taking in 38 in the fall and then letting 4 go could result in another lawsuit for the NCAA or to the school.
I don't think that they want that to happen.
